OLYMPIA, WA – The Washington State House of Representatives has passed House Bill 1774, legislation that allows the Washington State Department of Transportation (WSDOT) to incorporate social, environmental, and economic benefits into lease agreements for unused highway land. This landmark bill, sponsored by Representative Jake Fey (D-Tacoma) and a broad coalition of lawmakers, will create new opportunities for public agencies, special purpose districts, and community-based non-profit organizations to repurpose vacant highway land for community benefits.
“This bill is about putting unused highway land to work for our communities,” said Representative Jake Fey, Chair of the House Transportation Committee. “It ensures that properties that might otherwise sit vacant can be leased to support public housing, parks, shelters, and other vital services, while also ensuring appropriate safeguards are in place.”
Under the new law, WSDOT will have the discretion to consider the social, environmental, and economic benefits provided by a lessee when determining fair lease value. Eligible uses under the bill include:
- Affordable housing and shelter programs
- Public parks and enhanced public spaces
- Public recreation and transportation infrastructure
One key example of the bill’s potential impact is Pugnetti Park in downtown Tacoma, where WSDOT land could be leased to the Washington State History Museum for maintenance and restoration. Tacoma Public Schools has also expressed interest in utilizing WSDOT parcels for a joint vehicle maintenance facility.
The bill now moves to the Washington State Senate for further consideration. If passed and signed into law, it will take effect 90 days after the end of the legislative session.
